General conditions of entry for competitions/prize draws of Schumacher GmbH - Online Store
1.    Data protection
By participating in the competitions/prize draws, the participant expressly agrees that Schumacher GmbH may store the required data for the duration of the competition/prize draw and beyond. Participants are entitled to revoke their consent at any time and accordingly withdraw their participation. Schumacher GmbH employs the recorded data for market research, marketing and publicity purposes. Personal data submitted to Schumacher GmbH will not be disclosed to third parties. The winners consent to the publication of their name and place of residence.

2.    Participation/prize draws
Competitions/prize draws are conducted either by Schumacher on their own behalf or in cooperation with partners, depending on the promotion. The prize draw is restricted to Germany. The winner is selected by drawing lots at random. No entrant may win more than one prize. Prizes cannot be exchanged for cash nor may they be transferred to third parties. In the event that the prize cannot be awarded or is unacceptable in any way, the winner will receive a substitute prize of similar value. The winners will be notified by Schumacher GmbH in writing. Prizewinners failing to reply to the notification within 21 days will forfeit their claim to the prize and this will be awarded to another entrant to be chosen according to the same selection process. Entrants are responsible for providing their correct address. The announcement of the winners’ names is without guarantee.

3.    Entries, disqualification from the competition or the prize draw
Competitions are only open to individuals over 18 years of age. To qualify for entry in the competition/prize draw, participants agree to provide true and accurate personal data. Employees of Schumacher GmbH are excluded from participating. Schumacher GmbH reserves the right to disqualify any entry that it believes to be in breach of these conditions of entry, or to exclude any individual for a justified reason such as submitting more than one entry, exerting unlawful influence on the competition or otherwise seeking to obtain an advantage through manipulation of any kind, etc. In such cases, Schumacher may disallow prizes already awarded and demand their return or repayment thereof.

4.    Changes to the conditions of entry and termination of the competition/prize draw
Schumacher GmbH reserves the right to amend these conditions of entry at any time, to terminate the competition/prize draw prematurely or to change the schedule without prior notice, should there be a compelling reason. This applies in particular in cases where it is no longer possible to guarantee correct competition procedure. Should it be discovered that an entrant is responsible for the circumstances resulting in such a premature termination, Schumacher GmbH reserves the right to file a claim for compensation against that person.

5.    Liability
Schumacher GmbH can only be held responsible for any damage – irrespective of the legal grounds – if it was caused by culpable infringement of essential contractual obligations in a manner that jeopardised the contract or frustrated its purpose, or can be attributed to gross negligence. Should Schumacher GmbH be in breach of an essential contractual obligation, according to the above provision, without intent or gross negligence, liability will be restricted to the typical extent which Schumacher GmbH should have anticipated on entering into the contract in light of the circumstances known to them at the time. The aforementioned limitations and exclusions of liability do not apply in the case of culpable infliction of life-threatening injuries, bodily harm or endangering a person’s health, for liability claims according to product liability law or in the case of comprehensive, contractually agreed reimbursement obligations or fraudulent concealment of the circumstances providing the grounds for liability. Insofar as the liability of Schumacher GmbH is excluded or restricted in accordance with the terms of this exclusion of liability, this applies equally to the personal liability of corporate bodies, employees, representatives and vicarious agents.

6.    Miscellaneous
Should one or several of these conditions of entry become invalid or prove to be unenforceable, the validity of the other provisions shall remain unaffected. The invalid provision will be replaced by a valid regulation which is closest to the intended purpose of the original condition. The judges’ decision is final and no correspondence will be entered into. This ruling applies to all of our competitions and prize draws.
